“大数据杀熟”的法律规制研究

摘要： 随着大数据技术发展，“大数据杀熟”现象日益严重，侵害了消费者的诸多合法权益。针对该现象，在充分研究了其成因和目前规制困境的基础上，提出了完善相关法律规制的建议，使大数据能够更好地发挥其应有价值，有助于在互联网平台利益与消费者合法权益保护之间找到平衡点。

Research on legal regulation of the Big Data affinity

Abstract： With the development of Big Data technology, the phenomenon of “Big Data Affinity” is getting more serious, infringing on legitimate rights and interests of consumers. Therefore, this paper puts forward suggestions for improving relevant legal regulations on the basis of fully studying its causes and current regulatory dilemmas, so that Big Data can better play its due value. This is also helpful for finding a balance between the benefits of Internet platforms and the protection of rights and interests of consumers.

0 引言

近年來，隨著電商平臺規(guī)模的不斷增長，互聯(lián)網(wǎng)經(jīng)濟(jì)模式愈發(fā)多樣，我國居民已經(jīng)逐漸形成了全新的網(wǎng)絡(luò)消費(fèi)習(xí)慣，互聯(lián)網(wǎng)消費(fèi)已成為大勢所趨[1]。然而，互聯(lián)網(wǎng)消費(fèi)數(shù)據(jù)由于具有體量大、隱私性強(qiáng)等特點(diǎn)，其在流動過程中保護(hù)難度較大。而一旦這些數(shù)據(jù)被泄露或?yàn)E用，其后果將不堪設(shè)想。因此，對互聯(lián)網(wǎng)消費(fèi)數(shù)據(jù)空間進(jìn)行治理已成為當(dāng)務(wù)之急。

目前，在消費(fèi)互聯(lián)網(wǎng)中廣泛使用了大數(shù)據(jù)技術(shù)，該技術(shù)已有近20年的發(fā)展歷史。2005年，雅虎公司開發(fā)了Hadoop項目，使對結(jié)構(gòu)化數(shù)據(jù)的快速、可靠分析變?yōu)楝F(xiàn)實(shí)[2]。2008年，計算社區(qū)聯(lián)盟發(fā)表白皮書[3]，最早提出大數(shù)據(jù)概念。2011年，麥肯錫全球研究院在報告[4]中對大數(shù)據(jù)進(jìn)行了全方面介紹和展望，標(biāo)志大數(shù)據(jù)時代的正式到來。2017年，《大數(shù)據(jù)安全標(biāo)準(zhǔn)化白皮書》正式發(fā)布[5]，加速了大數(shù)據(jù)落地深耕，促進(jìn)了行業(yè)生態(tài)發(fā)展。

大數(shù)據(jù)技術(shù)完美符合互聯(lián)網(wǎng)時代的數(shù)據(jù)特點(diǎn)，近年來備受重視。然而隨著該技術(shù)的廣泛應(yīng)用，“殺熟”現(xiàn)象逐漸產(chǎn)生。本文在對“大數(shù)據(jù)殺熟”現(xiàn)象進(jìn)行深入分析的基礎(chǔ)上，指出了“大數(shù)據(jù)殺熟”所存在的法律問題并對其法律規(guī)制提出建議。
