数据跨境流动治理与对策研究

摘要： 数据是信息时代重要的国家战略资源，合理的数据流动在促进经济增长、加速创新、推动全球化方面发挥着重要作用。当前全球跨境数据流动监管体系处在形成关键期。我国作为全球数据资源大国，面临数字经济快速发展机遇，需要妥善规制处理数据跨境流动问题，在保障数据安全的基础上促进数据有序高效流动，为数字经济高质量发展提供有力支撑。在梳理美国、欧盟以及国际组织等主要国家和地区数据跨境流动研究最新进展的基础上，分析了各自特点，并结合我国数据跨境流动实际提出对策建议。

Research on governance and countermeasures of cross-border data flow

Abstract： Data is an important national strategic resource in the information age. Reasonable data flow plays an important role in promoting economic growth, accelerating innovation, and promoting globalization. At present, the global cross-border data flow supervision system is in a critical period of formation. As a large country with global data resources, China is facing the opportunity of rapid development of the digital economy. It needs to properly regulate and deal with the cross-border flow of data, promote the orderly and efficient flow of data based on ensuring data security, and provide strong support for the high-quality development of the digital economy. Based on the latest research progress on data cross-border flows in major countries and regions such as the United States, the European Union, and international organizations, this paper analyzes their respective characteristics and puts forward countermeasures and suggestions in combination with the actual situation of data cross-border flows in China.

0 引言
自2008年以來，數(shù)據(jù)流動對經(jīng)濟發(fā)展貢獻度已超過傳統(tǒng)貿(mào)易和投資，成為促進全球經(jīng)濟發(fā)展的重要力量[1]。全球已有200多個有關(guān)數(shù)據(jù)流動的法律法規(guī)，限制性水平在過去十年間翻了一番[2]。各國紛紛從最有利于自身經(jīng)濟發(fā)展和數(shù)據(jù)保護的角度出發(fā)，在國家安全、隱私保護、產(chǎn)業(yè)能力等多元因素的復雜影響下制定數(shù)據(jù)跨境流動治理規(guī)則，謀求數(shù)據(jù)安全保護與數(shù)據(jù)自由流動之間的平衡。
1 主要國家和地區(qū)數(shù)據(jù)跨境流動特點分析
當前，全球并未形成統(tǒng)一的跨境數(shù)據(jù)流動監(jiān)管體系，以美國為代表的“倡導境外數(shù)據(jù)自由流入但嚴格限制境內(nèi)數(shù)據(jù)流出的數(shù)據(jù)跨境流動”模式，以及以歐盟為代表的“充分性保護為前提的事前防御規(guī)制模式”成為塑造全球數(shù)據(jù)跨境流動規(guī)則體系的主導力量。
