数据交易监管理念及制度体系构建

摘要： 数据交易风险和数据交易秩序混乱致使数据交易监管成为必要，在考量数据二元价值、数据利益主体及数据交易监管时代语境的基础上，提出了以社会本位为理论基础、以权利安全和交易自由为原则、以数据交易秩序为追求数据交易监管理念体系，并进一步构建了包含主体监管制度、行为监管制度、监管责任制度的数据交易监管制度体系，以探寻数据交易监管的有效道路。

Data transaction supervision concept and institutional system construction

Abstract： The risks of data transactions and the disorder of data transaction order make data transaction supervision necessary. On the basis of considering the dual value of data, data stakeholders and the context of the era of data transaction supervision, this paper proposes a data transaction supervision concept system, which takes social standard as theoretical basis, takes rights security and transaction freedom as principles, and takes data transation order as pursuit. It further builds a data transaction supervision system including subject supervision system, behavior supervision system, and supervision responsibility system to explore the effective way of data transaction supervision.

0     引言

數(shù)據(jù)交易本身存在多種風(fēng)險(xiǎn)，一方面，數(shù)據(jù)交易產(chǎn)品的特殊性決定了其權(quán)益侵害的針對(duì)性，數(shù)據(jù)安全威脅、對(duì)隱私權(quán)與個(gè)人信息權(quán)益的侵犯成為了數(shù)據(jù)交易領(lǐng)域的潛在風(fēng)險(xiǎn)；另一方面，數(shù)據(jù)交易與傳統(tǒng)交易存有一定共性，壟斷、不正當(dāng)競(jìng)爭(zhēng)、產(chǎn)品質(zhì)量、市場(chǎng)準(zhǔn)入等傳統(tǒng)問(wèn)題在數(shù)據(jù)交易領(lǐng)域依舊存在。據(jù)統(tǒng)計(jì)，目前超過(guò)95%的數(shù)據(jù)交易均為零散的“一對(duì)一”交易甚至數(shù)據(jù)“灰市”“黑市”交易，場(chǎng)內(nèi)數(shù)據(jù)交易僅占數(shù)據(jù)市場(chǎng)總規(guī)模的4%，場(chǎng)內(nèi)正規(guī)交易缺乏吸引力。可以說(shuō)數(shù)據(jù)交易領(lǐng)域的風(fēng)險(xiǎn)已明顯暴露，尤其是數(shù)據(jù)交易本身的特性會(huì)使其整個(gè)過(guò)程處于不可視化的狀態(tài)，將最終會(huì)損害市場(chǎng)秩序和利益主體權(quán)益。
