数据主体主导的数据流通逻辑与实现路径研究

摘要： 数据上升为全新的生产要素，发展数据要素市场、激活数据要素潜能成为全球各国在数字时代抢占竞争优势的关键抓手，但数据资源分散、流通壁垒林立，共享、开放以及交易等流通路径面临诸多困境难以破题，数据流通的长效机制研究亟待建立。通过深度剖析数据控制主体主导的数据流通体系，分析其面临的困境及内在原因，充分借鉴全球各国对数据流通新路径的探索与实践经验，提出了数据主体主导的数据流通新路径，包括设计思路、基础与支撑、实施路径以及效益分析，为数据流通机制探索与模式创新提供参考。

Research on the logic and realization path of data circulation led by data subject

Abstract： As data becomes a new factor of production, the development of data element market and activation of the potential of data element become the key to seize competitive advantages for the countries around the world in the digital era. The problems of decentralized data resources and numerous data barriers are hard to crack. The study of a long-term mechanism of data circulation receives wide attentions. This paper analyzes the facing difficulties and internal reasons of the path of data circulation dominated by the data controllers, absorbing the practical exploration experience of countries around the world on new paths of data circulation. On this basis, the paper put forwards the design ideas, foundation and support, implementation path and benefit analysis of a new path of data circulation, to provide the reference for the exploration of mechanism exploration and mode innovation of data circulation.

0 引言

隨著數(shù)字時(shí)代的到來(lái)，數(shù)據(jù)已經(jīng)成為未來(lái)社會(huì)經(jīng)濟(jì)發(fā)展的核心戰(zhàn)略資源。全球各國(guó)積極制定國(guó)家數(shù)據(jù)戰(zhàn)略，激活數(shù)據(jù)要素動(dòng)能，搶占全球數(shù)據(jù)發(fā)展制高點(diǎn)。推動(dòng)數(shù)據(jù)要素安全流通和高效配置是加快數(shù)據(jù)要素價(jià)值釋放的重要基礎(chǔ)，高效安全的數(shù)據(jù)流通規(guī)則與實(shí)現(xiàn)路徑成為全球各國(guó)探索與實(shí)踐的焦點(diǎn)。歐盟數(shù)據(jù)立法走在全球前列，出臺(tái)了《通用數(shù)據(jù)保護(hù)條例》《非個(gè)人數(shù)據(jù)自由流通條例》等相關(guān)法規(guī)制度，引領(lǐng)著全球數(shù)據(jù)立法的風(fēng)向標(biāo)。美、英、日等國(guó)的探索起步較早，形成了以“藍(lán)綠按鈕”“Midata”“信息銀行”等為代表的個(gè)人數(shù)據(jù)管理的新型服務(wù)模式。隨著數(shù)據(jù)可攜帶權(quán)的設(shè)立，以數(shù)據(jù)主體為主導(dǎo)的個(gè)人數(shù)據(jù)流通路徑建設(shè)取得了實(shí)質(zhì)性突破，典型的如韓國(guó)的MyData模式。近來(lái)，歐盟《數(shù)據(jù)法》對(duì)數(shù)據(jù)可攜帶權(quán)進(jìn)一步延伸和細(xì)化，為數(shù)據(jù)主導(dǎo)的數(shù)據(jù)流通新路徑的探索留下了更大的實(shí)踐空間，引發(fā)了更廣泛的關(guān)注。
