论我国数据资源开发利用的立法完善

摘要： 我国积极探索推进数据要素市场化，加快构建以数据为关键要素的数字经济，围绕数据资源开发利用的法律制度体系建设取得了积极进展，形成了覆盖关键环节的体系框架及关键要求。随着我国数据要素市场化进程进一步走深走实，与国际数据治理规则竞争进一步加剧，现有的数据资源开发利用立法在支撑全国统一数据市场建设，以及引导、规范开发利用活动方面存在不足，应在数据基础设施、数据供给、数据流通、数据应用创新及数据跨境流动等关键环节进行立法完善。

Study on the improvement of legislation for development and utilization of data resources

Abstract： China actively promotes the marketization of data elements and accelerates the construction of a digital economy with data as the key element. A preliminary legal system has been established for the development and utilization of data resources. This legal system covers key data links and proposes key requirements. With the development of the data element market, China participates in the international competition of of data rules. However, the existing data legal system cannot support the development and utilization of data and is also insufficient to meet the development of a unified national data market. Based on the theoretical research and practical needs, this study concludes with proposals to solve the improvement of legislation problems of data infrastructure, data supply, data circulation, data application and innovation, data crossborder flow.

0 引言
隨著我國數(shù)據(jù)要素市場化進程進一步走深走實，與國際數(shù)據(jù)治理競爭進一步加劇，建立健全數(shù)據(jù)立法成為破解數(shù)據(jù)要素市場發(fā)展存在問題、搶占國際數(shù)據(jù)規(guī)則話語權(quán)的必然選擇。我國現(xiàn)有的數(shù)據(jù)資源開發(fā)利用立法在要求細化程度、規(guī)則統(tǒng)一程度等方面存在不足，需在數(shù)據(jù)基礎(chǔ)設(shè)施、數(shù)據(jù)供給、數(shù)據(jù)流通、數(shù)據(jù)應(yīng)用創(chuàng)新及數(shù)據(jù)跨境流動等關(guān)鍵環(huán)節(jié)進行補充完善，以更好地支撐全國統(tǒng)一數(shù)據(jù)市場建設(shè)，更有力地引導(dǎo)和規(guī)范數(shù)據(jù)資源開發(fā)利用活動。
