欧盟数据治理模式对我国数据要素开发利用的启示

摘要： 欧盟围绕数据资源开发利用经历了三个阶段的发展，构建形成了对全球影响极大、极具欧盟特色的数据治理路径，目前，欧盟正加快体系化实施数据战略，以推动壮大本土数字产业，形成与美、中抗衡的数字经济竞争力。欧盟数据战略主要包含健全数据管理机构、推动数据共享流通、建设数据基础设施以及建立数据治理规则等方面，在实践中取得了显著成效。立足我国数据要素开发利用中存在的数据流通交易不畅、数据价值挖掘不足以及安全保障仍待补强等问题，研究总结欧盟数据治理模式对我国的启示，旨在为数据要素探索实践提供参考。

The enlightenment of EU data governance model on the development and utilization of data elements in China

Abstract： The EU has gone through three stages of development around the development and utilization of data resources, and has formed a data governance path with great global impact and distinctive EU characteristics. Currently, the EU is accelerating the systematic implementation of data strategies to promote the growth of local digital industries and form a digital economy competitiveness that rivals the United States and China. The EU data strategy mainly includes improving data management institutions, promoting data sharing and circulation, building data infrastructure, and establishing data governance rules, which have achieved significant results in practice. Based on the problems in the development and utilization of data elements in China, such as unsmooth data circulation and transactions, insufficient data value mining, and insufficient security protection, this article studies and summarizes the inspiration of the EU data governance model for China, aiming to provide reference for the exploration and practice of data elements.

引言
我國率先在國際上提出將數(shù)據(jù)作為生產(chǎn)要素參與分配，這是我國發(fā)揮海量數(shù)據(jù)規(guī)模和豐富應用場景優(yōu)勢的創(chuàng)新性突破，也是構筑國家競爭新優(yōu)勢的戰(zhàn)略性舉措。隨著“數(shù)據(jù)二十條”等指導性文件的發(fā)布實施以及國家數(shù)據(jù)局的揭牌成立，社會各界加快開展數(shù)據(jù)要素化實踐，目前已有超過20個省級行政區(qū)成立數(shù)據(jù)局，“數(shù)據(jù)要素×”行動在各行各業(yè)探索落地，與此同時，數(shù)據(jù)交易、場景應用、安全合規(guī)等方面仍存在諸多問題亟待破解。本文研究總結了歐盟數(shù)據(jù)治理模式對我國的啟示，以期為我國數(shù)據(jù)要素探索實踐提供參考。
